Two hundred and thirty-five house buyers in the long delayed Taman JP Perdana and Bandar Pulai Jaya housing projects have been advised to sign the settlement agreement with the respective developer by the National Housing Department, Ministry of Housing and Local Government.
It’s deputy director of operations, Zainudin Tala said that the suggested solution is to allow all the house buyers of both the housing projects to take possession of their respective houses by the middle of next year.
He said that the remaining house buyers who refused to sign the settlement agreement will result in further delay and will have to face with the impending rise in constructions costs.
He advised the remaining house buyers who refused to sign the settlement agreement to be more far-sighted so as not to reach a stage where the housing developers will be faced with legal action which can cause the developers to go insolvent.
If that happen, it will affect the rest of the nine hundred sixty-four who have already signed the settlement agreement, he said.
Zainudin stressed that this is merely a suggestion and is not forcing the house buyers to accept the suggestion as he said; every disgruntled house buyer has the legal right to seek compensation from the defaulting housing developer.
He urged the house buyers concern to spare a thought for the rest of the nine and sixty-four buyers.
Zainudin was speaking in a press conference here yesterday. Also present was the director of private housing monitoring division, Ir Lai Liang Koong and the CEO of Oxbridge Heights Sdn. Bhd, the developer of JP Perdana housing project.
The completion of the two housing projects valued at RM60 million were delayed after the developers encountered financial problems during the 1997 financial crisis.
Oxbridge Heights Sdn. Bhd. is the developer for JP Perdana project whereas Hartaplus Realty Sdn. Bhd. is the developer for Bandar Pulai Jaya project respectively.
A special committee comprising the house buyers from the two housing projects, the developers and the National Housing department was formed in July 15, 2010 to look into ways in resolve the problems amicably.
A settlement agreement was drawn up where the house buyers shall agree waive their legal rights not to seek compensation from the developer and in return the developer shall complete the housing project bearing all the related additional construction costs.
Meanwhile, Lee said that two of the total fourteen phases have already issued with certificate of occupancy, one each in JP Perdana and Bandar Pulai Jaya and the construction works are progressing.
A house buyer in JP Perdana housing project, Yuesrie Othman, 39, urged those who have not sign the settlement agreement to do so for the interest of all parties.
