Appeal board set December 28 to decide SJRA intervention

Should SJRA successfully intervene the suit, the next hearing will be conducted on January 8, 2011.

Selangor appeal board today set December 28 as the date to consider an intervention filed by Subang Jaya Residents Association in the Subang Ria Park appeal following an objection voiced by appellant Sime Darby.

Appeal board judge Abu Bakar told the Sime Darby legal team to file in their documentations to rationalise their objections on the date, and that failing to do so will automatically qualify SJRA to participate in the appeal case.

Should SJRA successfully intervene the suit, the next hearing will be conducted on January 8, 2011.

SJRA legal advisor Derek Fernandez later told Komunitkini that Sime Darby does hold a strong point in pursuit of their appeal.

“There is a document stated that the State Planning Committee (SPC) agreed in principal to let Sime Darby develop 18.9 acres of the park,” he said.

He added that the decision was made by the current Selangor administration in 2009.

“There is big question mark here. If they haven’t been granted greenlight by MPSJ, how did SPC, which is a state-level body, come into picture?” he added.

He expected Sime Darby to use the document to question the legitimacy of  MPSJ in rejecting their development proposal in May.

SJRA chairman AS Gill is also worried about the presence of that document, but he said the document only stated “a consideration to let Sime Darby develop the land”.

“Anyhow we will still proceed with our action because many facts are in favour of our side,” he said.

Meanwhile, Subang Jaya Consumer Association (CASJ)chairman Lau Bing called on Sime Darby, which is a government-linked company, to echo the federal government’s recent budget allocations in promoting sustainable and green living.

“Without a park, there won’t be any sustainable development,” he said.

He also appealed to Selangor state government to correct the wrong done by the previous administration.

“It’s within the jurisdiction of state government to protect the park, there was never a world-standard city in which the residents have to run around to buy a park like us,”

Sime Darby has been appealing for MPSJ’s decision to reject their development plan that aims to sub-divide the 73.6 acres Subang Ria Park into a low-rise development and a modern park.

SJRA, which had been kept in dark about the appeal, filed in an affidavit to intervene Sime Darby’s appeal on Tuesday morning when they received a tip-off.
