The Bukit Jalil Estate imbroglio took another turn today as the Court of Appeal granted an ex-parte injunction against the High Court ruling on Wednesday, lifting the residents’ original injunction against Kuala Lumpur City Hall (DBKL), preventing it from demolishing the latter’s homes.
DBKL is barred from demolishing the last 41 homes at the last estate of Klang Valley temporarily.
Justice Apandi Ali granted the interim order at around 3.40pm in Putrajaya today. The ex-workers were represented by lawyer Muhammad Afiq and Adlan Hadi Yusof.
Two days ago, the High Court ruled that DBKL was entitled to evict the former estate workers under Emergency Ordinance 1969 (Squatter Clearance) as the eviction notices it had served on the residents were valid.
Parti Sosialis Malaysia secretary-general S. Arutchelvan hoped DBKL would not challenge the Court of Appeal’s order and instead negotiate with the residents who have been living there for four generations.
He said DBKL, as a public authority, should wait until a full-hearing of the court decides on the legal status of the residents and the validity of DBKL’s eviction notices in October.
