A lawyer who owns a 2.2 acre land at Gombak was shocked to find out that the Selayang Municipal Council (MPS) had resumed a road construction that trespasses his land just 27 months after the council gave an undertaking to court.
Rajbeer Singh, whose land is located near to the Gombak District Land Office, alleged that the council had approved a road construction that encroaches 0.9 acres of his land without consulting or compensating him.
Moreover, he chided MPS for committing the offence knowingly since its council president Zainal Abidin Azim gave an undertaking to court on June 27, 2008 and pledged not to enter Rajbeer’s land.
Rajbeer said he immediately lodge a police report after finding out that the construction work had resumed and was being carried out at an advanced stage on September 16, 2010.
“We sent a notice to Zainal Abidin the following day on the breach of undertaking. But despite that, the constructions were still carried out,” he said.
He felt that as the rightful owner of land titled Lot 3546, he is being blatantly disregarded by the council.

Moreover, he found out that there is a forthcoming development for a housing estate at the end of the road which is being constructed.
He suspects that MPS might have flashed the green light for the road engineer Alpway and contractor Metrogen or some other parties to carry out developments and then acquire his land later under “people requests”.
“They can avoid paying me compensations by doing this,” he alleged.
Rajbeer is also disappointed that his previous letters to seek helps from Selangor MB Khalid Ibrahim and Selayang MP William Leong did not receive any response.
He called a press conference today along with Selangor MCA Public Complaint Bureau chairman Theng Book.

Theng decried that MPS, which is supposed to be the law enforcement body, had committed a legal offence blatantly.
He condemned MPS’ councillors for endorsing a construction that has not undergone the proper process.
“The construction plan must have been presented to the local councillors during (monthly) full board (meeting). What procedure have they followed?” Theng asked.
“Same goes to Khalid and (William) Leong. Didn’t they promise speedy response? Where are they?” he further added.
He reminded the public to be wary of the housing development project near to the Gombak Land Office.
“If they come to know (of the project), they should be careful. Because the purchasers might have no access (to the properties they acquire) if Rajbeer brings the case to court and eventually wins,” he warned.
Meanwhile, the complaint bureau had advised Rajbeer to lodge a report to Malaysian Anti Corruption Commission (MACC) to investigate both the contractors and MPS for any irregularities.
